Terms of service

OVERVIEW Welcome to the Chinese American Construction Professionals (CACP). The terms “we”, “us”, and “our” refer to Chinese American Construction Professionals, a 501(c)(6) non-profit organization.

CACP operates this website, including all related information, content, features, tools, memberships, sponsorships, and services (collectively, the “Services”).

These Terms of Service (“Terms”) govern your access to and use of the Services. By visiting, interacting with, or using our Services (including purchasing memberships or sponsorships), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT By using the Services, you represent that you are at least the age of majority in your state or province of residence.

To purchase memberships or sponsorships, you may be required to create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account and password and for all activity that occurs under your account. You may not transfer, sell, or assign your account to another person.

SECTION 2 – OUR MEMBERSHIPS AND SPONSORSHIPS All memberships and sponsorships are digital services. We make every effort to describe them accurately. However, we do not guarantee that every benefit will meet your exact expectations.

We reserve the right to modify, discontinue, or limit any membership or sponsorship offering at any time without notice.

SECTION 3 – ORDERS AND PURCHASES When you place an order for a membership or sponsorship, you are making an offer to purchase. CACP reserves the right to accept or decline any order for any reason. Your order is not binding until we confirm acceptance and process your payment.

All purchases are subject to our Return and Refund Policy.

SECTION 4 – PRICES, BILLING, AND AUTO-RENEWAL Prices are subject to change without notice. The price at the time of purchase will be the price charged.

All memberships and sponsorships are automatically renewed every year unless you cancel. You may log into your account and cancel your subscription renewal at any time before the renewal date to avoid being charged for the next year.

If your subscription auto-renews and you wish to cancel afterward, you must do so within the 14-day refund window (see Return and Refund Policy below).

SECTION 5 – RETURN AND REFUND POLICY You may request a full refund within 14 days of the original purchase date or renewal date.

No refund will be issued if, within the 14-day period:

  • You (or your company representatives) attend any CACP event, seminar, workshop, banquet, mixer, or program.
  • You have already received any membership benefits or access.

To request a refund, email us at cacpcacp@yahoo.com within the 14-day window with your name, company name (if applicable), and order number. Refunds will be processed to the original payment method within 7–10 business days.

After the 14-day period, all purchases are non-refundable and non-transferable.

SECTION 6 – INTELLECTUAL PROPERTY All content on the Services, including text, images, logos, and materials, is owned by CACP or its licensors and protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written consent.

CACP’s names, logos, and slogans are trademarks of CACP. You may not use them without permission.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS We may provide access to third-party tools. These tools are provided “as is” without any warranties. We are not responsible for any third-party tools you choose to use.

SECTION 8 – THIRD-PARTY LINKS The Services may contain links to third-party websites. We are not responsible for the content or practices of any third-party sites. You access them at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY CACP is powered by Shopify. However, all sales of memberships and sponsorships are made directly between you and CACP. Shopify is not responsible for any aspect of your purchases or transactions with CACP. You release Shopify from any claims related to your purchases.

SECTION 10 – PRIVACY POLICY Your personal information is governed by our Privacy Policy. By using the Services, you acknowledge that you have read and agree to our Privacy Policy.

SECTION 11 – FEEDBACK Any feedback, suggestions, or ideas you submit become the property of CACP. We may use them without compensation or obligation to you.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS We reserve the right to correct any errors or inaccuracies on the Services at any time without notice, including after an order has been placed.

SECTION 13 – PROHIBITED USES You may not use the Services for any unlawful purpose or in any way that violates these Terms, infringes intellectual property rights, or harms CACP or other users. We reserve the right to terminate your access without notice if you violate these Terms.

SECTION 14 – TERMINATION We may terminate or suspend your access to the Services at any time, with or without cause. Sections related to intellectual property, disclaimers, liability, and indemnification will survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES The Services and all memberships/sponsorships are provided “as is” and “as available” without any warranties, express or implied.

SECTION 16 – LIMITATION OF LIABILITY To the fullest extent permitted by law, CACP shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

SECTION 17 – INDEMNIFICATION You agree to indemnify and hold CACP harmless from any claims, losses, or damages arising from your breach of these Terms or your use of the Services.

SECTION 18 – SEVERABILITY If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.

SECTION 19 – GOVERNING LAW These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Los Angeles County, California.

SECTION 20 – CHANGES TO TERMS We reserve the right to update these Terms at any time. Your continued use of the Services after changes are posted constitutes acceptance of the new Terms.
